Terms of Use

Last updated:

These Terms of Use govern your access to and use of the website sparkwyshoulder.world and the workspace ergonomics consultation services offered by Sparkwyshoulder from our Auckland premises and via remote delivery channels. By accessing our website or booking any consultation product, you agree to be bound by these terms.

1. About Sparkwyshoulder

Sparkwyshoulder provides professional workspace ergonomics consultations, desk wellness programmes, and related advisory services to individuals and organisations in New Zealand. Our services include the Essential Desk Review, Complete Workspace Audit, Corporate Wellness Package, and optional add-ons such as follow-up sessions and lighting assessments as described on our Ergonomic Offerings page.

2. Acceptance of Terms

By browsing sparkwyshoulder.world, submitting an inquiry, or engaging our services, you confirm that you are at least eighteen years of age, have the legal capacity to enter into binding agreements, and accept these Terms of Use in full. If you are booking services on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

3. Nature of Our Services

Our ergonomics consultations provide educational assessments, postural observations, workstation configuration guidance, and practical recommendations based on established ergonomic principles. Sparkwyshoulder does not provide medical, physiotherapy, chiropractic, or occupational therapy services. Our advice is intended to support workplace comfort and productivity and should not be interpreted as a substitute for professional healthcare advice.

If you experience persistent pain, numbness, or other physical symptoms, we encourage you to seek appropriate professional evaluation independently of our consultation services.

4. Booking and Service Delivery

Consultation bookings are confirmed upon receipt of payment or written agreement as communicated by our team. Session durations, deliverables, and follow-up periods are defined by the specific package purchased. In-person sessions are conducted at our Princes Street location or at your premises for Corporate Wellness Package clients within the Auckland region unless otherwise agreed. Remote sessions are delivered via video call using platforms we specify at the time of booking.

You agree to provide accurate information about your workspace and to make reasonable efforts to implement recommended adjustments. Failure to provide access to your workspace during a scheduled session may result in rescheduling fees.

5. Pricing and Payment

All prices displayed on sparkwyshoulder.world are in New Zealand dollars unless otherwise stated. Prices are subject to change, but confirmed bookings are honoured at the price agreed at the time of booking. Payment terms, accepted methods, and invoicing procedures are communicated during the booking confirmation process. GST applies where required under New Zealand law.

6. Cancellations and Rescheduling

Cancellation and rescheduling terms for consultation products are detailed in our Return Policy. Generally, cancellations made at least forty-eight hours before a scheduled session qualify for a full refund or rescheduling without penalty. Late cancellations may incur a fee reflecting our preparation time and reserved appointment slot.

7. Intellectual Property

All content on sparkwyshoulder.world, including text, graphics, logos, assessment report templates, and consultation methodologies, is owned by or licensed to Sparkwyshoulder and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without prior written consent.

Personalised assessment reports delivered to you as part of a consultation are provided for your individual or organisational use. You may not commercially redistribute report content or present it as your own professional work product.

8. Website Use Restrictions

You agree not to use sparkwyshoulder.world in any manner that could damage, disable, or impair the website, interfere with other users' access, attempt unauthorised access to our systems, transmit malicious code, scrape content for commercial purposes, or use automated tools to harvest data without permission. Your interactions with third parties are solely between you and those parties.

10. Disclaimer of Warranties

Our website and consultation services are provided on an as-is and as-available basis to the fullest extent permitted by law. While we apply professional care in delivering ergonomics assessments, we do not warrant that our recommendations will eliminate all physical discomfort, prevent all workplace injuries, or produce specific productivity outcomes. Results depend on individual factors including consistency of implementation, pre-existing conditions, and work environment variables beyond our control.

11. Limitation of Liability

To the maximum extent permitted by New Zealand law, Sparkwyshoulder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim relating to a consultation product shall not exceed the amount you paid for that specific product. 12. Consumer Guarantees

If you are a consumer as defined under New Zealand law, our services come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993. You are entitled to services that are carried out with reasonable care and skill, are fit for any particular purpose you make known to us, and are completed within a reasonable time. Remedies for failure to meet these guarantees are set out in our Return Policy.

13. Privacy

Your use of our website and services is also governed by our Privacy Policy, which explains how Sparkwyshoulder collects and processes personal data in connection with ergonomics consultations. By using our services, you acknowledge that you have read our Privacy Policy.

14. Governing Law and Disputes

These Terms of Use are governed by the laws of New Zealand. Any dispute arising from or relating to these terms or our consultation services shall first be addressed through good-faith negotiation. If resolution is not achieved, the courts of New Zealand shall have exclusive jurisdiction, subject to any rights you may have under applicable consumer protection legislation.
